If you elect not to add travel insurance, you will risk losing all or a portion of your rental payments in the event of an unforeseen cancellation.  Although travel Insurance is often quoted by Garden City Realty’s staff or displayed online during the check-out process, it is NOT added to the reservation unless explicit permission to do so has been provided. You may add Travel Insurance until 30 days before your arrival or when making your final payment, whichever comes first. If the policy premium is received within 21 days of the initial rental deposit, and you are not disabled from travel when you pay the plan cost, the Pre-Existing Condition exclusion will be waived. For reservations booked more than 30 days before arrival, the coverage may be canceled within 14 days of confirming a reservation or adding it to an existing reservation for a full refund of the premium paid. ** If you elect to decline travel insurance coverage (which Garden City Realty advises against), you will be subject to Garden City Realty’s standard cancellation policy, which could put Renter at risk to lose reservation/rental payments. 

RESERVATIONS ARE NONREFUNDABLE. If a reservation is canceled and Garden City Realty is able to re-rent the same property covering the same date range for the total dollar amount of your original reservation, Garden City Realty will provide an 80% refund of your reservation payment. If Garden City Realty is able to re-rent the same property covering the same date range for a lesser total dollar amount than your reservation, the difference will be withheld from your reservation payment, in addition to the 20% cancellation fee.  All refunds are subject to Garden City Realty’s discretion. No refunds will be issued unless and until after the property is re-rented and those monies are received. A request to change the reserved property to a different property will be considered the same as a cancellation, and any potential refunds will be subject to these provisions herein.

GUEST AGREEMENT

Garden City Realty hereby enters into a binding contractual agreement with the undersigned Renter. By signing this agreement, all parties agree and accept to be bound by these terms.

1. LIABILITY FOR DAMAGES: Aside from normal wear and tear, Renter will be held responsible for damages to the property or its contents during your vacation residency. Should damages occur during your stay, Garden City Realty is granted the right to charge your credit card or bank account on file. Garden City Realty is not responsible for overdrafts or over limit fees. 

2. WAIVER OF SECURITY DEPOSIT: Instead of a refundable cash security deposit, there is a nonrefundable waiver of security deposit charged for each property. This fee covers up to $1,000 of any non-negligent property damages reported during your stay. The payment does not cover any damages resulting from violating this agreement.

3. FAMILIES ONLY: Vacation rentals are intended for family accommodations only. Garden City Realty does not rent to house parties and strictly prohibits using properties to host events or parties, including weddings and rehearsals. Garden City Realty considers a house party to be (but not limited to) chaperoned or unchaperoned church, college, high school, middle school, or similar groups of young adults, whether or not they are related. Any misrepresentation on the part of the guest in this area will render this contract null and void, and the guest will forfeit all monies. If Renter has any questions regarding our FAMILIES ONLY POLICY, please contact Garden City Realty Management at (843) 651-2121 before Renter confirms reservation. 

4. RESPONSIBLE PARTY: I understand that I am responsible for ensuring that the FAMILIES ONLY POLICY is followed as outlined above. In addition, by entering into this rental agreement, I agree not to allow any person inside this home or on this property at any time during the dates of this rental period not listed as part of this rental agreement as of today. I understand that substitutes are only allowed for people listed in this rental agreement with written approval by a Garden City Realty manager on or before 72 hours of arrival date.

5. MINIMUM AGE: Garden City Realty exclusively rents to persons 25 or older, and guests under the age of 25 will not be allowed to check into the reservation. By signing this agreement, you are confirming that you are 25 or older, and in the event you are not, it will be considered a breach of contract and you will not be entitled to a refund of any monies paid.

6. ACCEPTED FORMS OF PAYMENT: Includes cash, personal checks, cashier’s checks, bank-issued money orders, e-checks, and all forms of electronic payment with a valid credit card on file. Garden City Realty also accepts Visa, MasterCard, Discover, or American Express. Reservations booked with a credit card incur a 3% convenience fee calculated on the total amount of the reservation. Convenience fees are nonrefundable. A credit card must be used as the primary form of payment for all Reservations booked within 30 days of the scheduled arrival date.

7. PAYMENT POLICY: A reservation deposit equal to 10% of the total rent is required at booking (includes travel insurance, if applicable); an installment equal to 50% of the outstanding balance is due 180 days before the scheduled arrival; the final payment of the remaining balance is due 30 days before arrival date. For reservations made within 180 days (six months) of expected arrival, a payment equal to the first and second deposit (10% deposit and 50% installment) is due at the time of booking. A MasterCard, Visa, Discover, or American Express card may be required to be on file for your reservation. If the deposits are not paid by the due date, Garden City Realty will automatically charge the credit card or bank account on file. Garden City Realty is not responsible for overdrafts or over-limit fees. THIRD-PARTY RESERVATIONS MAY BE SUBJECT TO FULL PAYMENT AT THE TIME OF BOOKING.

MONTHLY STAYS: One Month Stay: One-half of the monthly rent plus the total Travel Insurance premium, if applicable, is due at booking. The remaining balance is due 30 days before arrival. Two Month Stay: The first month's rent in its entirety, plus the total Travel Insurance premium due at booking. The remaining balance is due 30 days before arrival. Three Month Stay: The first month's rent in its entirety, plus the total Travel Insurance premium is due at booking. The second month's rent in its entirety, all fees, and security deposit are due 30 days before arrival. The remaining balance is due at check-in. Four, Five, and Six Month Stay: The first month's rent in its entirety, plus the total Travel Insurance premium is due at booking. The second month's rent in its entirety, all fees, and security deposit are due 30 days before arrival. The third month's rent is due in its entirety on arrival date. The fourth month's rent is due in its entirety at the beginning of the second month's stay. The fifth month's rent is due in its entirety at the beginning of the third month's stay. The sixth month's rent is due in its entirety at the beginning of the fourth month's stay. If payment is not received by 5:30 p.m. on the fifth of the month, a late fee of 10% of the past due rent will be assessed, and the tenant will be subject to eviction.

9. ACTS OF NATURE: In the event a reservation is interrupted or check-in is delayed through no fault of Garden City Realty or renter, including but not limited to natural disasters such as hurricanes, tropical storms, high winds, or beach erosion, no refunds will be issued, regardless of whether a mandatory evacuation order has been issued by local governing authorities. (Note: Travel Insurance may protect you from these inherent risks. Please contact Red Sky or another travel insurance agent for details and information).

11. SUBSTITUTION/FULL REFUND: Garden City Realty reserves the right to substitute comparable accommodations or refund your payments without further liability if your chosen accommodation becomes unavailable for rental. This right shall not, however, obligate Garden City Realty to provide substitutable accommodations under any circumstances, including those listed in portion number nine(9) “Acts of Nature” of this agreement

12. SUBLEASING: This agreement shall not be assigned, transferred, or subleased without prior written consent.

13. REPAIRS: Garden City Realty does not guarantee air conditioning, plumbing, appliances, pools, hot tubs, Wi-Fi, or any other amenity included with our vacation rental properties. Refunds will NOT be issued in the event of any of the aforementioned breakdowns. 

14. ENTRY: Occasionally, an employee or vendor of either Garden City Realty or the Homeowner Association must enter a vacation rental for the property’s repair, care, and management. This shall include anything related to the sale of a property - sales showings, home inspections, etc. In the event that entry to your rental property is necessary, Garden City Realty or its designee(s) maintain the right to enter for those explicit purposes with or without notice.

15. OWNERS CLOSET: Locked closets are reserved for the owner’s private property and are not included in the property rental. In the event that an owner's closet is accessed or disturbed, it will be considered a breach of this contract by renter, and Garden City Realty maintains the right to keep the security deposit and obtain restitution for any lost or damaged property or items.

16. OCCUPANCY: Occupancy of the property shall be deemed to have occurred when I or anyone in my traveling party has utilized the unique guest access code or received keys provided by Garden City Realty.

17. PETS: Pets are prohibited unless stated in the property description. Guests who violate this policy will be required to provide proof of pet boarding for the remainder of the vacation, will be assessed a fee no less than $500 per pet, will forfeit any coverage afforded by the waiver of the security deposit, will be held responsible for any additional cleaning costs, and will be held liable for any damages resulting from the presence of the pet(s) for up to 90 days after departure. Emotional support dogs are restricted to dog-friendly properties.

18. PARKING: Parking is limited and restrictions are noted in the vacation rental description. Garden City Realty is not liable for damages, fines, and expenses incurred by the guest.

19. CHECK-IN: Check-in is not to be expected before 4 p.m. Check-in begins at 4 p.m., depending on property availability, and extends to the close of business. Although we strive to ensure properties are ready at 4 p.m., it is not guaranteed. There may be instances that result in delayed check-ins. When this happens, Garden City Realty reserves the right to withhold entry from guests until the property is deemed ready for occupancy.

20. CHECK-OUT: Unless otherwise told or given express written consent, check-out must take place prior to 10 a.m. on the scheduled day of departure as displayed as a part of this Guest Agreement. Guests checking out after the approved time will incur a fee no less than $150.

21. LOST KEYS: A fee of no less than $25 for lost keys and no less than $100 for lost access devices to the property or amenity, including but not limited to key cards, key fobs, garage door openers, and State Park passes will be charged to the credit card or bank account on file.

22. LOST AND FOUND: Garden City Realty is not responsible for items left behind. If found, a fee of no less than $20 plus the cost to return an item upon request will be charged to the credit card or bank account on file.

23. LINENS & TERRY: If Garden City Realty provided linens and towels are excessively soiled, damaged, or stolen during your occupancy, Renter will be charged either $250 or the replacement cost of the linen, whichever is greater. 

24. NON-SMOKING PROPERTIES: All properties managed by Garden City Realty are non-smoking. Garden City Realty will charge the credit card or bank account on file a fee of no less than $1,000 plus related expenses, including, but not limited to, cleaning costs and loss of future rent for anyone who smokes in a non-smoking property.

25. FIREARMS, WEAPONS, AND AMMUNITION: Garden City Realty, Inc. prohibits any person from openly carrying or brandishing any firearm or weapon onto our properties.  Guests or visitors who are lawfully permitted to possess a firearm or weapon may bring it on the premises only if it is concealed. Any guest who fails to follow this provision will be considered in breach of this agreement, and will give Garden City Realty the right to require you to vacate the rental property without a refund. An exception to the restrictions described in this policy applies to law enforcement officers and designated military personnel, while on duty and required to carry firearms or weapons in the performance of their duties. There will be no exemption to this policy for private persons;  even for those persons otherwise licensed and permitted to carry a firearm or weapon openly under state law. All firearm and weapon owners must remove them at or prior to departure from the property.  In the event a guest leaves a firearm or a weapon in a property it is imperative that they immediately contact Garden City Realty. Guests who fail to remove them upon their departure will be assessed a penalty of not less than $500 and have 5 business days to arrange for pick up of the item(s).  Upon the lapse of 5 business days the item will be surrendered to the law enforcement department that has jurisdiction.

26. ELECTRIC VEHICLES & CHARGERS/MOTORHOMES: Unless otherwise noted on the individual property listing, chargers for electric vehicles are not provided. With the exception of golf carts, charging electric vehicles from a property or running extension cords to vehicles is prohibited. Garden City Realty strictly prohibits RVs/motorhomes from being connected to any of our properties. If discovered, it will be considered a breach of this provision, and Garden City Realty will be given the right to charge a fine to the credit card or bank account on file.

27. EQUIPMENT RENTALS: The guest agrees to sign a separate agreement for any equipment rentals provided by third-party companies, including, but not limited to, VayKLife.

28. DISCLAIMER OF LIABILITY: GARDEN CITY REALTY IS NOT RESPONSIBLE FOR ANY ACCIDENTS, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF MONEY, JEWELRY, OR VALUABLES OF ANY KIND. By signing this agreement, you are agreeing that in the event of any of the preceding events, renter is waiving the right to sue or file a claim for recovery for any of those damages.

FORCE MAJEURE: Garden City Realty shall not be liable or accountable, or be deemed to have defaulted under or breached this agreement, for any failure or delay in fulfilling or performing any term hereof or tenant property damages caused by acts, circumstances or forces beyond Garden City Realty reasonable control including, but not limited to, acts of God, electrical surges, electronic device malfunctioning, lightening, flooding, hail, hurricanes, wind, storms, erosion, strikes, lock-outs, acts of utility companies or government authorities, travel restriction or advisory, quarantine, pandemic, epidemic, national or regional emergency (including any public health emergency), government order or law or any other matter beyond the reasonable control of Garden City Realty.

GOVERNING LAW: The Parties agree that this agreement shall be construed and interpreted in accordance with the laws of the state of South Carolina, without regard to conflicts of law principles.

SEVERABILITY: The Parties agree that, if any part or parts of this Agreement are held to be invalid or unenforceable by a court, the court shall nevertheless uphold and enforce the remaining provisions and construe the invalid portion(s), if any, as severable from the remaining terms of this agreement, except as to material terms set forth above.

ENTIRE AGREEMENT, NO OTHER REPRESENTATIONS, AND COMPREHENSION OF DOCUMENT: This Agreement reflects the entire agreement of the Parties. Neither GCR or Renter is relying on any collateral, oral, or written representations or promises in undertaking as an inducement to enter into this agreement. Any previous agreements between the parties regarding the subject matter herein, if any, are merged herein. The terms of this Agreement are fully understood and voluntarily accepted by all parties and are not subject to modification or waiver except by means of a writing signed by all parties. The parties intend for the provisions contained in this Agreement to be as broad and comprehensive as permitted by law.

EFFECTIVENESS: This agreement shall become effective immediately following execution hereof by Renter on the date that Renter signs (The “Effective Date”).


NOTE: BY SOUTH CAROLINA REAL ESTATE LAW, YOUR RESERVATION DEPOSIT BELONGS TO RENTER UNTIL THE COMPLETION OF YOUR RESERVATION.


I, THE UNDERSIGNED, UNDERSTAND THAT THE RENTAL DEPOSITS PLACED WITH GARDEN CITY REALTY, INC. FOR THE PURPOSE OF RESERVING A RENTAL PROPERTY BELONG TO ME, AND AS OWNER OF THE FUNDS, ANY INTEREST EARNED SHALL ACCRUE TO MY BENEFIT. HOWEVER, IT IS AGREED AS A PART OF THIS GUEST AGREEMENT THAT ALL INTEREST INCOME FROM THIS DEPOSIT TO THE DATE OF RENTAL OR IN THE EVENT OF FORFEITURE SHALL ACCRUE AND HAVE BEEN ASSIGNED TO THE BENEFIT OF GARDEN CITY REALTY, INC.
